Although BHS, Inc. has taken great care in the preparation of BHSestimator (the software), NO WARRANTIES, EXPRESSED OR IMPLIED are made. BHS, Inc. specifically and expressly DISCLAIMS ANY WARRANTIES, EXPRESSED, IMPLIED, STATUTORY, BY OPERATION OF LAW OR OTHERWISE, INCLUDING MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE with respect to BHSestimator and its use. In no event shall BHS, Inc. be liable for ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES sustained or suffered by the user in connection with or arising out of the use, furnishing or performance of BHSestimator.
BHS, Inc. warrants that its Database and Database Updates, which are separate and apart from BHSestimator, contain the most current pricing available. The Database pricing with BHSestimator is current as of the date on the update. Pricing updates will be furnished separately from BHSestimator only to subscribers of the BHSestimator Database Update service. However, BHS, Inc. assumes no responsibility or liability for any prices used by a user of the BHSestimator. All pricing should be checked against local suppliers.
WARNING! BHS, Inc. is not responsible for lost physical keys. If a loss should occur, a replacement key is available for the purchase price of the BHSestimator. Damaged keys can be replaced at a cost dependent on the type of key, the age of the key, and the status of the customer’s Annual Site. Version 7 of the BHSestimator eliminated the need for physical security keys.
Service Contract
The BHSestimator is a tool designed to assist the professional estimator in preparing fast, accurate, high-quality estimates. There are four basic steps to produce an accurate estimate takeoff:
BHSestimator provides considerable information for determining actual costs and profit margins. It does not compromise the material takeoff abilities of the professional estimator; rather it provides a fast and accurate vehicle to generate job takeoff and labor costs. Bid summary and recap generations are done easily and accurately with the BHSestimator package.
BHSestimator automatically prices all items based on current market prices (assuming that the individual user’s database has been kept current). It will apply labor units for each item from the database at the same time. Both the price and labor are easily modified; simply enter the requirements for each item and BHSestimator will perform the extensions.
With BHSestimator, bids are generated item by item and/or with assemblies. Regardless of the estimating method used, the ability to add, delete, and modify each item in a bid is done with considerable ease.
Finally, the user has the capability of generating and modifying the estimate cover sheet. As the estimate is built, the user can easily follow and correct the result of the bottom line. A facility is provided to allow the user to activate or deactivate pages of the estimate, thus providing "what if" capability. As a result, an accurate estimate is produced in a fraction of the time it would have taken using alternate methods.
The BHSestimator* Software License
1. GRANT OF LICENSE. BHS, INC, grants to the user the right to use and to reproduce all (NOT a portion) of the BHSestimator for Windows install set for use within your company structure provided that:
(i) the Software is not distributed for profit;
(ii) the Software is used only in conjunction with licensed copies of BHSestimator for Windows products;
(iii) the Software may NOT be modified;
(iv) all copyright notices are maintained on the Software; and
(v) the licensee/end user agrees to be bound by the terms of this Agreement.
COPYRIGHT
The Software is owned by The BHS, Inc. and is protected by United States copyright laws and international treaty provisions. The user may not remove the copyright notice from any copy of the Software or any copy of the written materials, if any, accompanying the Software. This product contains Formula One V6.1 from Visual Components, Copyright 1994-2001, all rights reserved. This product contains Handsontable, including Hyperformula, based on the commercial license granted to BHSestimator. © 2023, Handsoncode. All rights reserved.
3. OTHER RESTRICTIONS - This BHS License Agreement is your proof of license to exercise the rights granted herein and must be retained by the user. The user may not rent or lease the Software. The user may not reverse engineer, de-compile or disassemble the Software.
NO WARRANTY - ANY USE BY THE USER OF THE SOFTWARE IS AT YOUR OWN RISK. THE SOFTWARE IS PROVIDED FOR USE ONLY WITH MICROSOFT WINDOWS 32 BIT PLATFORMS AND RELATED SOFTWARE.THE SOFTWARE IS PROVIDED FOR USE "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHS, INC. AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
BHS, INC. IS NOT OBLIGATED TO PROVIDE ANY UPDATES TO THE SOFTWARE.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES - In no event shall The BHS, Inc. or its suppliers be liable for any damages whatsoever (including, without limitation, incidental, direct, indirect special and consequential damages, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use this BHS, INC. product, even if BHS, INC. has been advised of the possibility of such damages. Because some states/countries do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to the user.
U.S. GOVERNMENT RESTRICTED RIGHTS
The Software and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable.
